        1、PSC檢查情況
        A 2004 built general cargo ship was detained due to the following deficiency:
        一艘 2004年建造的雜貨船,因為以下缺陷被滯留:
        01199 Other (certificates) -TYPE OF SHIP GENERAL CARGO BUT CARGO LOADING ON BOARD BULK CARGO, SHIP DOES NOT HAVE IMSBC CERTIFICATE (Reference: SOLAS ch. I, IMSBC CODE)
        Upon receipt of the letter below from the RO, the ship was released. 
        PSCO在接到 RO發來的下述信息后,將船舶釋放。

        2、復議方觀點
        However, the RO expressed disagreement on the detention with the view that: 
        RO對不同意此次滯留,理由如下: 
        (1)As  provided  in  the  Preshipment  Analysis Certificate that  the  cargo is  “non-hazardous”, thus the ship is not required to have a  certificate  for  carriage  of dangerous goods.
        根據船舶的 Preshipment Analysis Certificate,船舶沒有裝危險貨物,因此船舶不需要具備危險貨物證書。

        (2)Although IMSBC Code is mandatory under SOLAS Convention for ship carrying solid bulk cargo, but there is no requirement that the ship must have an IMSBC certificate or an IMSBC document of compliance. The IMSBC certificate/ document of compliance is not listed in the Annex 1 -Certificates and documents required to be carried on board ships of SOLAS Convention as well as FAL.2/Circ.127-MEPC.1/Circ.817-MSC.1/Circ.1462 with regard to the List of certificates and documents required to be carried on board ships, 2013. 
        對于散貨船而言,由于 IMSBC CODE被 SOLAS公約引用而具備了強制性,但是規則內并沒要求船舶必須配備 IMSBC證書或符合聲明。根據 SOLAS公約 Annex 1及 FAL.2/Circ.127-MEPC.1/Circ.817-MSC.1/Circ.1462的要求,船舶并不要求攜帶 IMSBC證書。

        (3)There is also no specific requirement for issuance of IMSBC certificate/document of compliance within the national legislation. Therefore, the issuance of IMSBC certificate/document of compliance to the national flagged ships carrying solid bulk cargoes is not mandatory.
        同時國際公約中沒有強制簽署 IMSBC證書的條款,簽發該證書不是強制的。 

        3、港口國的觀點
        (1)The ship would load the Palm Kernel Expeller as the cargo, which is listed in the IMSBC Code. Ship’s type is general cargo but the ship did not have any documents that the ship comply for carrying the cargo, such as Document of Compliance for IMSBC Code or other relevant document of compliance for carrying solid bulk cargo.
        該輪裝載的是棕櫚油渣,該類貨物屬于 IMSBC規則監管的范圍。船舶的類型為 general cargo ship,但是船舶沒有提供證明具備裝載 solid bulk cargo能力的證書或文書。

        (2)The ship master couldn’t explain the situation but the cargo loading had been started without cargo information for ship’s master. Therefore, the ship was detained.
        船長不能解釋這種狀況,在沒有向船長提供貨物信息的情況下裝載貨物。因此船舶被滯留。

        (3)The Preshipment Analysis Certificate is of no use as the issuing company is not recognized/approved by its Authority. And it is not a matter that the cargo is hazardous or not butthe vessel should have the document of compliance for carriage of the solid bulk cargo.
        Preshipment Analysis Certificate是公司簽發的,沒有被主管機關認可,因此是無效的。本案例不是貨物危險貨不危險的問題,而是船舶在裝載 solid bulk cargo時應簽發相應證書的問題。

        Therefore the detention was justified.
        因此滯留合理。

        (1)There is NO IMSBC certificate. The deficiency is not appropriately addressed. It would be appropriate to use deficiency code 01316-Cargo information instead of 01199-other(certificates)
        對于船舶不能提供 IMSBC證書的缺陷,應該使用缺陷代碼 01316,而不是 01199 

        (2)There is NO requirement from IMSBC code for carriage of “document of compliance”, except for dangerous goods.
        除了危險貨物, IMSBC code中沒有要求攜帶符合證書的條款。 

        (3)It is an issue that the master did not have necessary knowledge and information about the cargo being loaded.
        這是一個船長沒有足夠的裝貨相關知識的問題。

        (4)In accordance with IMSBC code, it is the responsibility of shipper to provide cargo information to the master. Therefore, whether the ”Preshipment analysis certificate” referred to in this case is recognized by the port state authority or not should not be a fault of the master or the vessel.
        按照 IMSBC規則的要求,承運人有責任向船長提供貨物信息。無論怎么講本案例中的 preshipment analysis certificate 不應該認定為船長或船舶的缺陷。
